Sovereignty Council Stresses Activation of Constitutional Court and Rule of Law

Sovereignty Council member Abdullah Yahya reaffirmed the state’s commitment to upholding the rule of law, strengthening state authority, and activating the role of the Constitutional Court, which has remained suspended for more than four years. He emphasized that this is essential for advancing the state and its institutions, protecting citizens’ rights, and guaranteeing their freedoms.

During his meeting today with Constitutional Court Chief Justice Wahbi Mohamed Mukhtar, Yahya affirmed the government’s support for the court’s plan to carry out its mandate in applying laws and legislation—particularly regarding judicial disputes and personal status matters—and enforcing them across all residents of the state.

For his part, Chief Justice Mukhtar explained that the meeting addressed the role and importance of the Constitutional Court in establishing the rule of law and advancing the country during this critical transitional stage. He stressed the necessity of applying the law equally to all residents.

In a press statement, Mukhtar highlighted that the rule of law is based on the presence of a genuine constitution endorsed by the nation, separation of powers, and the Constitutional Court’s role in ensuring that state laws comply with the constitution. He clarified that the court does not interfere in the work of the judiciary but rather monitors the functioning of the three branches of power in the interest of safeguarding freedoms and rights.

He added that through his meetings with several Sovereignty Council members, he has sensed a strong commitment to the principle that the enforcement of the law is the only pathway to strengthening the state and its institutions, and the sole guarantor of social peace.
